Terms & Conditions

These Terms cover all Delivery.gi services. Almost everything below applies to every order; only the way you order and pay differs between our two services, which is set out in clause 4: (a) the Amazon self-service portal — pay the total shown at checkout; and (b) our general concierge service — we send you a quote to accept and pay.

Important notice: These Terms & Conditions govern all services provided by Delivery.gi to private and business customers. By using our website or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. They set out your rights and obligations, as well as those of Delivery.gi, in relation to the ordering, transportation, customs clearance, and delivery of goods. We are licensed by the Office of Fair Trading (OFT) Gibraltar, Licence No. BL151839.

1. Introduction & Acceptance

This website and service is operated by Delivery.gi (“Delivery.gi”, “we”, “us”, “our”), a trading name of East Gate Express Services Ltd, The New Harbours (Head Office), Unit 9, Harbours Yard, Gibraltar GX11 1AA. These Terms & Conditions, together with any referenced documents such as our Privacy Policy, govern your use of our website and services. By accessing or using this website or placing an order through us, you (“you”, “your”, “Customer”) agree to be bound by these Terms & Conditions. If you disagree with any part of these Terms & Conditions, you must not use our services.

2. Eligibility & Use Limitations

This website is intended for users who are 18 years old or above. By using the site, you confirm that you are at least 18 years of age. You may use the site only for lawful purposes and in accordance with these Terms & Conditions.

Restricted items. You may not use our services to order any of the following:

We may also decline any goods whose import into Gibraltar is restricted or prohibited by law. Our systems aim to prevent orders for restricted items, but if such an item is ordered, you are solely responsible, and we may cancel the order, refuse delivery, and decline a refund.

3. Service Description

Delivery.gi acts as a broker between you and the retailer or supplier from whom you wish to purchase goods. Our role is to facilitate your order, manage logistics, customs clearance, and final delivery. We are not the supplier or manufacturer of the goods.

We offer two ways to order:

  1. Amazon self-service portal — you find items on Amazon.es through this website (search or paste a link) and pay the total shown at checkout.
  2. General concierge service — you tell us what you want from any UK or Spanish retailer (usually via WhatsApp) and we send you a quotation to accept and pay.

In both cases, when you place an order via Delivery.gi we will:

  1. Submit your order to the retailer or supplier;
  2. Arrange collection of the goods;
  3. Manage transport to Gibraltar;
  4. Handle customs clearance, import duties, and taxes;
  5. Arrange delivery to your home or specified address, or make the goods available for collection.

We arrange your order online and have the goods delivered to our warehouses in Spain and the United Kingdom, from where we transport them to Gibraltar.

We handle the entire order from start to finish (end to end). We do not accept, collect, or handle goods that you have already purchased independently — our service only covers orders that we arrange and place on your behalf.

Third-party websites. We purchase from third-party retailer websites. We are not responsible for the authenticity, legitimacy, or accuracy of any third-party website or its content (including product images, descriptions, or representations). If a website turns out to be fake or fraudulent, any claim or legal action in respect of it is a matter between you and that website — we accept no responsibility. We also reserve the right, at our sole discretion, to decline any order, or to refuse to purchase from any website or retailer we consider unreliable, fraudulent, high-risk, or associated with counterfeit or infringing goods.

4. Orders, Pricing & Payment

You must provide accurate details for the goods you wish to purchase (for example, the product link or reference and quantity), and accurate contact and delivery details. We will not purchase goods until payment has been received in full. The way you order and pay depends on which of our two services you use:

4a. Amazon self-service portal

The portal shows you the full price at checkout, payable in full before we proceed. The total you pay is made up of:

  1. the product cost (the Amazon retail price, including VAT);
  2. our service fee of 15% of the product price;
  3. the actual delivery/handling cost of getting the item to our warehouse; and
  4. for home delivery, a flat £5 delivery charge — collection is free.

We re-check the live Amazon price before charging. If the price has increased beyond a small tolerance since you added the item, we will show you the updated total before you pay; a price that has fallen is charged at the lower amount. Payment is taken securely by card via our payment provider (Revolut).

4b. General concierge service

For orders from other UK or Spanish retailers, we issue a quotation which you must accept and pay before we proceed. The quoted total is inclusive and covers: (i) the product cost (retail price); (ii) import duties, taxes, and customs fees; and (iii) all transport, handling, and delivery costs. Our standard service fee for this service is 20% of the total order value, subject to a minimum of £10 (or the Euro equivalent), regardless of order value. Payment must be made by the methods we specify (such as bank transfer or card payment).

We are not liable for damages or refunds. All products and services are provided by independent suppliers, and any decisions regarding refunds, replacements, credits, cancellations, or compensation are made at the sole discretion of the relevant supplier.

All quotes and prices are in GBP or EUR, as applicable. Where currency conversion applies, we use the prevailing exchange rate (including a small buffer to cover conversion costs), shown before you pay.

VAT / IVA. The price you pay includes any VAT or Spanish IVA charged by the retailer or supplier in the country of purchase. This VAT/IVA forms part of the product cost and is not separately reclaimable or refundable by you, and we are unable to reclaim it or pass it back to you.

5. Order Fulfilment, Delivery & Timing

After payment, we aim to purchase and dispatch your order within two working days. Delivery times vary depending on the retailer and country of origin. As a general guide:

These estimates may vary based on courier schedules, customs processing times, or retailer dispatch delays. If an item becomes unavailable after you place your order, we will notify you promptly and may offer an alternative or refund that portion. Partial deliveries may occur where part of your order is ready before the rest. We take no responsibility for defects in, or damage to, goods caused by the supplier or retailer — such claims lie between you and the supplier (we will assist where we can; see clause 6). Risk of loss or damage in transit to Gibraltar lies with the retailer until the goods reach you; once delivered to you or collected by you, responsibility passes to you. Once your items arrive at our Gibraltar depot, you have 48 hours to accept and collect them, unless otherwise agreed with us in writing. After this period we reserve the right to charge a storage fee of £5 per day, per item.

Delivery to a specified location. If you ask us to deliver or leave your items at a particular place (for example, outside your door, in a porch, or another unattended location), you do so at your own risk. Once the items are delivered or left as you instructed, we are not liable for any loss of, or damage to, the items.

6. Inspection, Defects & Reporting

We inspect all goods upon arrival at our facility for visible external damage. From the moment you receive your items — whether by collection or delivery — you have 24 hours to notify us in writing of any defects, damage, discrepancies, or missing items. This must be read together with clause 5: while we take no responsibility for damage caused by the supplier, notifying us within 24 hours allows us to help you raise the matter with the supplier or retailer where possible. If you fail to notify us within this time frame, Delivery.gi will not accept liability for any issues thereafter. Where a defect is verified as ours, our liability is limited to the original cost of the goods. We are not liable for consequential losses, incidental damages, or loss of use beyond the purchase price.

7. Returns, Refunds & Cancellations

Because we act as a broker, Delivery.gi does not directly facilitate returns or refunds in most cases; these are typically managed between you and the retailer or supplier. If you wish to return or refund an item, you may choose either of the following:

  1. we can provide you with a quote to manage the return or refund process on your behalf; or
  2. we can provide you with copies of all relevant documentation (invoices, order receipts, and shipping records) so that you may manage the process directly with the retailer or supplier.

Exchanges & refunds (general / non-Amazon orders): where you wish to exchange an item or request a refund, we will provide you with all the relevant paperwork to pursue this. Please note that our service fee is non-refundable once our service has been carried out (that is, once we have placed and processed your order on your behalf). Where the delivery charge has been paid but your item is not delivered to you, the delivery charge will be refunded.

Refunds depend on the supplier. Where a refund is due — whether the item is returned by you or by us — we can only pass a refund on to you once we have received the corresponding refund from the supplier or retailer. We are unable to refund you before the supplier has refunded us.

Refunds are not instant. Refunds follow a process. Once a refund has been approved, please allow up to 48 hours for us to process it; your bank or card provider may take a little longer to show it in your account.

Return window (change of mind). If you simply wish to return an unwanted item — where there is no defect, fault, or damage — you must notify us within 15 days of receipt. Requests made after this period will not be accepted. Any item returned must be unused and in its original, resalable condition with all packaging. This window is separate from, and does not extend, the time limit for reporting defects or damage under clause 6.

If your order has already been placed with the retailer, cancellation may not be possible and could incur an administrative cancellation fee. Costs associated with returns, such as shipping, customs, and restocking fees, will typically be borne by you unless otherwise agreed.

8. Limitation of Liability & Disclaimers

To the fullest extent permitted by law, Delivery.gi and its officers, employees, and agents exclude all liability for indirect, incidental, or consequential damages; loss of profit, revenue, business, or goodwill; and delays or failures beyond our reasonable control. Our maximum aggregate liability under these Terms shall not exceed the total fees you paid to us for the relevant order. We do not guarantee uninterrupted or error-free access to the website. We are not liable for delays or failures caused by circumstances beyond our control, including but not limited to natural disasters, strikes, government actions, shipping disruptions, customs delays, or pandemics.

9. Intellectual Property & Website Use

All content, designs, logos, and trademarks on this website are owned by or licensed to Delivery.gi. You may not reproduce, copy, modify, or distribute any content without our prior written consent. You agree not to use the website or our services in any way that is unlawful or that interferes with others' use of the service.

10. Data Protection & Privacy

Our Privacy Policy explains how we collect, use, store, and protect your personal data. By using our website or placing an order, you agree to that policy. We may share necessary data with retailers, customs authorities, couriers, and other third parties only to the extent required to fulfil your order.

11. Customs & Import Compliance

While Delivery.gi handles customs clearance, we are not responsible for import refusals, delays, or additional charges arising from issues with the retailer's documentation or local customs rules. Any duties or taxes that change after your order has been placed will be your responsibility.

12. Disputes, Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Gibraltar. Any disputes arising under or in connection with these Terms shall, where possible, first be resolved amicably through discussion or mediation. If a resolution cannot be reached, the matter shall be submitted to the exclusive jurisdiction of the courts of Gibraltar.
